Agreeing to these terms
These terms cover your use of the Hastings Concrete website and any estimate, scheduling or work you arrange with us. By using the site or hiring us, you agree to them, so please read them before you book a job.
If something here doesn't fit your project, tell us before work starts. A written agreement signed by you and Hastings Concrete for a specific job wins over these terms where the two differ.
The services we offer
Hastings Concrete is a concrete contractor in Hastings, NE. We build driveways, patios, sidewalks, steps, garage floors, slabs, footings, foundations and retaining walls, and we do decorative work, raising and cutting. You can see the full list on our home page and read more about the crew on our about page.
What the site says about our work is general information to help you plan. It isn't a quote or a promise about your job, because every yard, slope and old slab is different and we only know the details once we've seen it.
Estimates and pricing
We give free in-person estimates with no obligation, and we respond within 1 business day once you reach out. Your estimate lists the work we plan to do and the price for it, based on what we can see on site.
An estimate is good for the time written on it, because concrete, steel and fuel prices change. If we open up the job and find something nobody could see beforehand, like soft ground under the old slab or buried debris, we'll stop, show you and agree on any change in price with you before we go on.
Changes you ask for after the estimate, like a bigger patio, a different finish or added steps, may change the price and the schedule. We'll put those changes in writing before we do the work.
Scheduling and cancellation
We set your pour date together, but weather has the last word. Rain, high winds, freezing nights and extreme heat can all hurt fresh concrete, so we may move a pour to protect the slab, and we'll tell you as soon as we know.
You can cancel or reschedule by calling (402) 512-8901 or through our contact page. Please give us as much notice as you can. If we've already ordered concrete, bought materials or dug out the area, you agree to pay for the costs we can't get back.
We may cancel or delay a job if the site isn't ready or safe to work, if access is blocked, or if a payment due before work starts hasn't been made.
Your part of the job
You agree to give our crew clear access to the work area and to tell us about anything buried that we can't see, like sprinkler lines, drain tile, pet fences or private electric and gas lines. We have public utility lines marked before we dig, but we aren't responsible for damage to private lines you didn't point out.
You also agree to follow the curing instructions we give you. Fresh concrete needs time before it can take foot traffic or a vehicle, and walking, driving or parking on it too early can leave marks or cracks that aren't our responsibility.
Payment terms
When payment is due, including any deposit and the final balance, is written on your estimate or agreement. Unless that document says otherwise, the balance is due when the work is finished.
If a payment is late, we may pause any remaining work until it's paid. You agree to pay reasonable costs of collecting an overdue balance, to the extent Nebraska law allows.
Our guarantee and what it doesn't cover
We're licensed and insured, and we guarantee your satisfaction on every job. If you're not happy with our work, call us and we'll come look at it and make it right where the problem is ours. Any written warranty for your job is spelled out in your agreement.
Concrete is a natural material, and some things are normal for it. Fine hairline cracks, small color differences between pours, and shading across a stamped or colored surface can happen even on a well-built slab, so they aren't defects. Control joints, the grooves we cut into the slab, are there so it cracks in those lines instead of across the middle.
Our guarantee doesn't cover damage from ground movement or settling outside the area we prepared, from water running onto the slab from roofs, downspouts or a neighbor's yard, from deicing salts, heavy equipment or loads beyond what the slab was built for, or from changes someone else made after we finished.
Apart from the guarantee above and anything written in your agreement, we make no other promises about our work, stated or implied, to the extent the law allows.
Limits on our liability
To the extent the law allows, Hastings Concrete isn't liable for indirect or follow-on losses, like lost use of your property, lost income or costs of other contractors you hired. Our total liability for any job is limited to the amount you paid us for that job.
We aren't responsible for delays or problems caused by things outside our control, like weather, supply shortages, utility outages or the actions of other contractors on your property.
Using this website
You may use this site to learn about our work and to reach us. You agree not to misuse it, copy its content for commercial use, or try to interfere with how it runs.
Links to other websites are there for your convenience. We don't control those sites and aren't responsible for what they say or how they handle your information.
Settling a disagreement
If something goes wrong, call us first at (402) 512-8901. Most problems get solved by standing at the slab together and talking it through, and we'd rather fix it than argue about it.
If we can't settle it that way, we both agree to try mediation in good faith before going to court. Any lawsuit that still follows will be brought in the state courts that serve Hastings, Nebraska.
Governing law
These terms and any work we do for you are governed by the laws of the State of Nebraska.
Changes to these terms
We may update these terms from time to time, and the version on this page is the one in effect. Changes don't affect a job already covered by a signed agreement unless you and Hastings Concrete agree in writing.
If you have a question about any of this, reach us through our contact page or call (402) 512-8901.
